Hearing Health Group, LLC ("Hearing Health Group," "we," "us," "our," or "the Company") operates this website subject to the following Terms of Service. "Client," "You," and "Your" refer to the individual accessing this website, who, by doing so, agrees to be bound by these Terms.

You acknowledge that hearing loss may be associated with serious or life-threatening medical conditions that should be evaluated by a licensed physician or otolaryngologist. If your hearing evaluation indicates a potentially serious condition, you will be advised to seek appropriate medical care.

No Medical Advice — Online Hearing Screening

Hearing Health Group may provide an online hearing screening tool solely to help determine whether you may be a candidate for our hearing aids and to assist in developing your hearing profile.

Please note:

  • An online hearing screening is not a medical examination.
  • A hearing aid will not restore normal hearing.
  • The U.S. Food and Drug Administration (FDA) recommends that individuals receive a medical evaluation from a licensed physician before purchasing a hearing aid.
  • Some states require an in-person medical evaluation before hearing aid purchases. Our online screening may not satisfy those legal requirements.

Permitted Use

This website is intended for individuals 18 years of age or older and is provided solely for personal, non-commercial use.

By using this website, you agree that you will not:

  • Use the website for any unlawful purpose.
  • Use the website in any manner inconsistent with these Terms.
  • Attempt to interfere with the operation or security of the website.

Hearing Health Group reserves the right to:

  • Refuse service
  • Cancel orders
  • Suspend or terminate user accounts
  • Discontinue transactions

at our sole discretion.

Children

Hearing Health Group does not knowingly sell products intended for children and does not knowingly collect personal information from individuals under the age of 18.

Individuals under 18 may only use this website with the supervision of a parent or legal guardian.

We encourage parents and guardians to educate children about the safe and responsible use of personal information online.

Medical Waiver

By purchasing a hearing aid from Hearing Health Group, you acknowledge the following:

  • You are 18 years of age or older.
  • Hearing Health Group has advised you that the FDA recommends obtaining a medical evaluation from a licensed physician (preferably one specializing in diseases of the ear) before purchasing a hearing aid.
  • You have chosen not to obtain such a medical evaluation prior to your purchase.
  • You understand that although an examination performed by a Hearing Health Group audiologist may not reveal any condition requiring referral to a physician, it remains in your best health interest to undergo a medical evaluation by an ear specialist at least once every three (3) years.

You further acknowledge that none of the following conditions apply to you:

  1. Visible congenital or traumatic deformity of the ear.
  2. Active drainage from the ear within the previous 90 days.
  3. Sudden or rapidly progressive hearing loss within the previous 90 days.
  4. Acute or chronic dizziness.
  5. Unilateral hearing loss of sudden or recent onset within the previous 90 days.
  6. Audiometric air-bone gap equal to or greater than 15 decibels at 500 Hz, 1,000 Hz, and 2,000 Hz.
  7. Significant cerumen (earwax) accumulation or a foreign body in the ear canal.
  8. Pain or discomfort in the ear.

If any of these conditions apply, Hearing Health Group cannot legally sell you a hearing aid without appropriate medical clearance.

Reselling Products Prohibited

Products purchased from Hearing Health Group, whether through this website or any other sales channel, are intended solely for personal use.

The resale, redistribution, or commercial resale of any Hearing Health Group products is strictly prohibited.

Limitation of Liability

To the fullest extent permitted by applicable law, Hearing Health Group and its affiliates, officers, directors, employees, agents, licensors, and suppliers shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from:

  • Your use of this website;
  • Your inability to use this website;
  • Errors or omissions in website content;
  • Business interruption;
  • Loss of profits;
  • Loss of data; or
  • Any other damages related to your use of this website.

Hearing Health Group reserves the right to modify website content at any time without prior notice and shall not be liable for any consequences resulting from those modifications.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Hearing Health Group, its officers, directors, employees, agents, licensors, affiliates, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' and accounting fees) arising out of or related to:

  • Your use of this website;
  • Your violation of these Terms of Service; or
  • Your violation of any applicable law or the rights of another person.
